How to Handle Broker Freight Disputes, Claims, and Offset Deductions

Why Freight Disputes Threaten Carrier Cash Flow

Even when a broker is financially healthy, billing disputes can freeze payments. Common pretexts include disputed seal records, minor pallet scuffs, late delivery deductions, or detention disputes. Understanding your contractual rights under the Carmack Amendment is essential for resolving conflicts promptly.

Crucial Steps for Bulletproof Delivery Documentation

  • Clean Bill of Lading (BOL): Always verify the receiver stamps and signs the BOL with date, time, piece count, and driver name. Any notation of damage must be documented immediately with time-stamped photographs before leaving the dock.
  • Temperature Logs for Reefers: Download and archive electronic reefer datalogger files immediately upon unloading to dispute fictitious temperature rejection claims.
  • GPS and Timestamped Geofence Data: Maintain ELD location records verifying arrival times for detention and on-time delivery proof.

Unlawful Broker Offsets

Under federal regulations, freight brokers cannot arbitrarily offset a cargo claim against an unrelated freight invoice without carrier consent or formal judicial adjudication. If a broker withholds funds from Load B to satisfy an alleged claim on Load A, they may be in breach of contract.
